Terms of Service

Please read these Terms of Service ("Terms") carefully before using Engage, operated by Cardinal Technologies, Inc. ("Cardinal Technologies," "we," "us," or "our"). By creating an account or using Engage, you agree to be bound by these Terms. If you do not agree, do not use Engage.

1. Eligibility

You must be at least 18 years old and authorized to act on behalf of any committee or organization you register to use Engage. By using Engage, you represent that you meet these requirements.

2. Accounts

You are responsible for maintaining the security of your account and for all activity that occurs under it. You must provide accurate information when registering. You may not share your login credentials with others or create accounts for the purpose of abuse. Notify us immediately if you suspect unauthorized access to your account.

3. Subscriptions and Billing

Engage is offered on a subscription basis. Subscription fees are billed in advance on a monthly or annual cycle, as selected during signup. All fees are charged through Stripe, Inc. By subscribing, you authorize us to charge your payment method on a recurring basis.

• Trials: We may offer a free trial period. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.
• Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; no partial refunds are provided for unused time.
• Price changes: We reserve the right to change subscription prices with 30 days' notice. Continued use after a price change constitutes acceptance of the new price.

4. Permitted Use

Engage is designed to support lawful political canvassing, voter outreach, petition drives, and related campaign activities. You agree to use Engage only for these lawful purposes and in compliance with all applicable federal, state, and local laws, including laws governing:

• The use of voter registration files and related data.
• Political advertising, solicitation, and campaign finance reporting.
• Telephone and electronic communications (including TCPA requirements).
• Privacy and data protection.

5. Prohibited Use

You may not use Engage to:

• Engage in commercial solicitation, spam, or any activity unrelated to lawful political purposes.
• Harass, threaten, stalk, or discriminate against any individual.
• Access voter data for any purpose other than lawful political canvassing and outreach.
• Attempt to gain unauthorized access to any account, system, or network.
• Reverse engineer, decompile, or copy any portion of the Engage platform.
• Violate any applicable law or regulation.

6. Voter and Contact Data

Voter registration data provided through Engage is sourced from publicly available state voter files and is provided for use in lawful political activities only. You are solely responsible for ensuring your use of voter data complies with all applicable laws. We reserve the right to suspend or terminate access if we determine that voter data is being misused.

7. Intellectual Property

Engage and its content, features, and functionality are owned by Cardinal Technologies, Inc. and are protected by copyright, trademark, and other applicable laws. These Terms do not grant you any right to use our trademarks, logos, or other proprietary information. Your committee's data remains your property; we do not claim ownership of content you create or upload.

8. Privacy

Your use of Engage is subject to our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers

Engage is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that voter data will be complete or accurate, as voter data is sourced from third-party state databases outside our control.

10. Limitation of Liability

To the fullest extent permitted by law, Cardinal Technologies, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Engage. Our total liability for any claim arising from these Terms or your use of Engage shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Cardinal Technologies, Inc. from any claims, losses, or expenses (including attorneys' fees) arising from your use of Engage, your violation of these Terms, or your violation of any applicable law.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms, non-payment, or any other reason at our sole discretion. You may delete your account at any time by contacting us. Upon termination, your right to use Engage ceases immediately.

13. Governing Law

14. Changes to These Terms
